By clicking "Submit Application" and uploading the requested documents (including but not limited to government-issued identification, driver's license, educational records, and any other personal documentation), you ("Applicant") hereby acknowledge, understand, and voluntarily consent to the following terms regarding the collection, processing, storage, and retention of your personal information:
1. PURPOSE AND LEGAL BASIS FOR DATA COLLECTION
You acknowledge that Smartwash Pro, LLC ("the Company") collects your personal information, including sensitive personally identifiable information ("SPII"), solely for the following legitimate business purposes:
- Evaluation of your qualifications and candidacy for employment as a carrier/driver;
- Verification of identity, work authorization, and eligibility for employment in the United States;
- Compliance with Federal Motor Carrier Safety Administration (FMCSA) regulations, including driver qualification files;
- Conducting background checks, motor vehicle record checks, and drug/alcohol testing as required by 49 CFR Parts 40 and 391;
- Verification of driving history and compliance with Department of Transportation (DOT) requirements.
Legal Basis: This collection is conducted pursuant to 49 U.S.C. § 31133, the Fair Credit Reporting Act (FCRA) (15 U.S.C. § 1681 et seq.), and applicable state employment laws.
2. VOLUNTARY SUBMISSION AND CONSENT
You understand that:
- The submission of documents containing SPII (including driver's license numbers, Social Security numbers, dates of birth, and medical certification information) is voluntary but necessary for the Company to evaluate your application and comply with federal and state transportation regulations.
- Refusal to provide required information will result in the inability to process your application or consider you for employment.
- By proceeding, you provide explicit, informed, and unambiguous consent for the Company to collect, process, and retain this data in accordance with this Acknowledgment.
3. DATA SECURITY AND SAFEGUARDS
The Company implements comprehensive administrative, technical, and physical security measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction, in compliance with:
- Louisiana Database Security Breach Notification Law (La. Rev. Stat. § 51:3071 et seq.);
- Florida Information Protection Act (Fla. Stat. § 501.171);
- Mississippi Breach Notification Law (Miss. Code § 75-24-29);
- Federal Trade Commission (FTC) Safeguards Rule (16 CFR Part 314) for financial information.
Security Measures Include:
- Encryption of data in transit (TLS 1.2 or higher) and at rest (AES-256);
- Role-based access controls limiting document access to authorized HR personnel and hiring managers with legitimate business need;
- Regular security audits and vulnerability assessments;
- Secure, SOC 2 Type II certified cloud storage infrastructure.
4. DATA RETENTION AND DISPOSAL
Your personal information will be retained only for as long as necessary to fulfill the purposes outlined in Section 1, or as required by applicable law:

Secure Disposal: Upon expiration of the retention period, your records will be securely destroyed using methods that render the information unreadable and irrecoverable. This complies with La. Rev. Stat. § 51:3074(B), Fla. Stat. § 501.171(7), and Miss. Code § 75-24-29(5).
5. DATA BREACH NOTIFICATION OBLIGATIONS
In the event of a security breach, the Company will notify you in accordance with the strictest applicable timeline:

The Company will not sell, rent, or lease your personal information to third parties for marketing purposes.
7. APPLICANT RIGHTS AND ACKNOWLEDGMENTS
By submitting this application, you confirm that:
- Accuracy: All information provided is true, complete, and accurate. False information may result in disqualification.
- Right to Access: You have the right to request access to the personal information we maintain about you.
- Non-Discrimination: Your decision to provide information will not result in unlawful discrimination.
- Electronic Signature: Your click of the "Submit Application" button constitutes a valid electronic signature under the E-SIGN Act.
8. GOVERNING LAW AND JURISDICTION
This Agreement shall be governed by the laws of the State of Louisiana. Disputes shall be resolved in courts located in Louisiana.
